1. The SACAA Disclaimer
General Disclaimer & Regulatory Status
LegendSky Ground School operates exclusively as an independent, supplementary e-learning platform and digital study aid. We provide preparatory theoretical courseware, quizzes, and revision materials intended to assist pilots in preparing for their South African Civil Aviation Authority (SACAA) theoretical examinations.
LegendSky is not a registered Part 141 Aviation Training Organisation (ATO). We do not issue official Letters of Recommendation, sign off on mandatory classroom hours, or grant formal aviation licenses. Our materials are designed to complement, not replace, the official instruction provided by a registered flight school.
2. The POPIA Privacy Statement
Protection of Personal Information (POPIA) Statement
LegendSky is committed to protecting your privacy and ensuring your personal information is collected and processed properly, lawfully, and transparently in accordance with the Protection of Personal Information Act (POPIA) of South Africa.
- Information Collection: We collect personal information (such as your name, email address, and billing details) strictly for the purpose of facilitating course enrollment, providing access to our e-learning platform, and communicating essential account updates.
- Data Security: We employ robust technical and organizational measures, including secure socket layer (SSL) encryption and secure payment gateways, to safeguard your data against unauthorized access, loss, or destruction.
- Third-Party Sharing: Your personal information is never sold to third parties. It is only shared with trusted operators (such as our local payment gateway) strictly to process your requested transactions.
- Your Rights: You have the right to request access to the personal information we hold about you, request corrections to inaccurate data, or request the deletion of your account at any time by contacting our designated Information Officer.
Data Retention
We retain your personal information for as long as your account remains active, and thereafter only for as long as reasonably necessary to fulfil the purposes described above, comply with our legal, tax, or regulatory obligations, resolve disputes, and enforce our agreements. When your information is no longer required for these purposes, we will securely delete or de-identify it.
Children's Personal Information
Some of our students enroll while under the age of 18. Where a user is a minor, we require that account registration and course purchase be carried out by, or with the verifiable consent of, that minor's parent or legal guardian, in accordance with Section 34 and 35 of POPIA. If we become aware that a minor's personal information has been submitted without the required parental or guardian consent, we will take reasonable steps to obtain that consent or, failing that, to delete the information concerned. Parents and guardians may contact our Information Officer at any time to review, correct, or request deletion of a minor's information.
Cross-Border Transfers
We do not knowingly transfer your personal information outside of South Africa, except where necessary for trusted service providers who assist us in operating the platform (such as our hosting provider or payment gateway) to deliver their services. Where this occurs, we take reasonable steps to ensure those providers apply a comparable standard of protection to your information as required under POPIA.
Data Breach Notification
In the unlikely event of a security compromise that results in unauthorised access to or acquisition of your personal information, we will notify the Information Regulator and affected users as soon as reasonably possible, in accordance with Section 22 of POPIA.

Our e-learning platform uses cookies and similar technologies to keep you logged in, save your course progress, remember your cart contents, and ensure the platform functions securely. By using our platform, you consent to the use of these essential functional cookies.

3. Terms & Conditions & Refund Policy
1. Introduction & Brand Affiliation Notice
This website and e-learning platform are independently operated by Preston Aviation PTY Ltd.
Please note that the LegendSky name, branding, and logo are used on this platform under explicit, verbal authorization from LegendSky management. This platform is an authorized provider of ground school training materials, but the financial, legal, and operational processing of all courses is handled strictly by the Service Provider. By visiting our site and/or purchasing a course, you agree to be bound by these terms and conditions.
2. Ground School Enrollment & Access
By purchasing a course on this platform, you are granted a non-exclusive, non-transferable license to access the course materials for your personal educational use. Course sharing, reproduction, or distribution of any materials (including downloadable PDFs or quiz contents) without explicit written permission is strictly prohibited and will result in immediate termination of access without a refund.
3. Payment Options & Currency
All prices listed on our website are in South African Rand (ZAR). Payment must be settled in full before access to any course or module is granted. We accept the following payment methods:
- Secure Online Payments: Processed via PayFast (including Credit/Debit cards and Instant EFT).
- Direct Bank Transfer (Manual EFT): You may elect to pay via direct bank transfer into our corporate bank account. If you choose this method, your course access will be manually activated once the funds have cleared and reflected in our account. Please send proof of payment to the support email listed below.
4. Payment Gateway Security
All online transactions are processed securely through PayFast, a trusted and secure payment gateway in South Africa. We do not store or have access to your credit card numbers or banking passwords.

This website is governed by the laws of South Africa. The Service Provider chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents, the physical address listed above.
6. Digital Goods & Refund Policy
Due to the digital and proprietary nature of our e-learning platform, we strictly enforce a refund policy that complies with the Electronic Communications and Transactions Act (ECTA) of South Africa.
Under ECTA, the standard 7-day "cooling-off" period does not apply to digital content once the consumer has begun downloading, streaming, or accessing the materials. Therefore, to protect our intellectual property, transactions are considered final once a course has been accessed.
We will only issue refunds under the following specific circumstances:
- Un-Accessed Purchases: If you purchase a course by mistake, you may request a full refund within 7 days of purchase, provided that our system logs show you have not accessed, viewed, or downloaded any part of the course material.
- Unresolvable Technical Issues: If you experience a persistent, documented technical error on our platform (e.g., a system failure preventing you from loading your course or taking a required quiz) that our technical support team cannot resolve within 5 business days, a full or partial refund will be issued.
- Merit-Based Requests: If you experience a highly exceptional life event (such as a sudden medical disqualification affecting your pilot training), you may submit a formal request. These requests are evaluated strictly on a case-by-case basis by management, and approval is entirely at our sole discretion.
7. How to Request a Review
To log a technical issue or submit a case for review, please email support@legendskygroundschool.com within 7 days of your purchase. Your email must include:
- Your full name
- Registered account email address
- The name of the course purchased
- Your payment reference (PayFast ID or bank transfer proof)
- A detailed explanation of your request
8. Changes to These Terms
We reserve the right to update or modify these Terms, our privacy policy, or our pricing at any time. Any changes will take effect immediately upon posting to this page, as indicated by the "Last updated" date above. Your continued use of the platform after a change is posted constitutes your acceptance of the revised terms.
4. Fair Use & Acceptable Use Policy
To keep our courses fairly priced and accessible for everyone, and to protect the integrity of our study materials, the following rules apply to all accounts:
One Account, One Person
Each course license is granted to a single named individual for their own personal educational use. Sharing your login credentials, letting another person use your account, or purchasing a course on behalf of someone else to use under your login is not permitted. We do not currently enforce this with a technical device or session limit — it is a condition of your access, and accounts found to be shared may be suspended or terminated under Section 2 of these Terms.
No Redistribution or Scraping
You may not copy, screen-record, scrape, bulk-download, republish, or otherwise redistribute our quiz questions, courseware, videos, or other materials, in whole or in part, outside of the platform. This includes compiling our questions into a third-party question bank or study group resource.
Honest, Independent Use
Our platform is intended to help you build genuine understanding of the SACAA theory syllabus. Please use it independently and honestly — the goal is to prepare you to fly safely, not just to pass a quiz.
Respectful Use of Support & Community Features
Please use our support channels and any community or feedback features in good faith. Abusive, false, or excessive requests unrelated to genuine platform issues may result in restricted access to those features.
User-Generated Content
If you post comments, questions, or other materials in our community forum or other interactive features, you retain ownership of that content, but you grant Preston Aviation PTY Ltd a non-exclusive, royalty-free license to display, moderate, reproduce, or remove it in connection with operating the platform. We are not responsible or liable for any user-generated content, and we reserve the right to remove or restrict any post that violates this Acceptable Use Policy.
Consequences
Violating this policy may result in a warning, suspension, or permanent termination of your account, at our discretion, without a refund, in addition to any other rights we have under these Terms.

If you believe someone is misusing our platform or your own account has been compromised, please contact us at support@legendskygroundschool.com.
5. Trust & Security
We take reasonable, industry-appropriate steps to protect your data and our course content. This is a summary of our approach — we don't publish exhaustive technical detail, as doing so could itself create a security risk.
Website & Data Security
- All traffic to and from our website is encrypted via SSL/HTTPS.
- Our site runs behind a web application firewall and malware-scanning service (Wordfence) that monitors for and blocks common attack patterns.
- Administrator accounts are required to authenticate with two-factor authentication in addition to a password.
- Access to student and account data is limited to staff who need it to operate the platform.
Payment Security
All card and EFT payments are handled entirely by PayFast, a PCI DSS-compliant payment gateway. We never see, receive, or store your full card number, CVV, or online banking credentials — these are entered directly on PayFast's secure payment page, not on our site.
Hosting & Backups
Our platform is hosted with a reputable South African-facing hosting provider, with regular backups maintained as part of our hosting service.
Reporting a Security Concern
If you believe you've found a genuine security vulnerability on our platform, please report it to admin@legendskygroundschool.com rather than testing it further or disclosing it publicly. We'll acknowledge your report and investigate promptly.
6. Intellectual Property
All course content, quiz questions, written materials, videos, branding, and software on this platform are the property of Preston Aviation PTY Ltd and/or its licensors, and are protected by South African and international copyright law. Except for the limited personal-use license described in Section 3.2, nothing on this platform may be copied, reproduced, modified, distributed, publicly displayed, or used to create derivative works without our prior written consent.
Any trademarks, logos, or brand names appearing on this platform (including the LegendSky name and branding) remain the property of their respective owners and are used under the arrangement described in Section 3.1.
7. Limitation of Liability & Disclaimer of Warranties
Our platform is provided on an "as is" and "as available" basis. While we work to keep it accurate, up to date, and available, we do not guarantee that it will be uninterrupted, error-free, or free of viruses or other harmful components, and we make no warranty, express or implied, as to the completeness or accuracy of any content on the platform.
As set out in Section 1, our courseware is a study aid, not a guarantee of examination success or of any aviation qualification. Passing our internal quizzes does not guarantee a pass in your official SACAA examination.
To the maximum extent permitted by South African law, Preston Aviation PTY Ltd, its directors, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential loss or damage (including loss of profit, data, or opportunity) arising from your use of, or inability to use, this platform, even if we have been advised of the possibility of such loss. Nothing in this section limits any liability which cannot lawfully be excluded or limited under South African law.
8. Governing Law & Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or your use of this platform, are governed by the laws of the Republic of South Africa, and are subject to the jurisdiction of the South African courts, as set out in the Country of Domicile clause in Section 3.5.
Before pursuing formal legal action, we encourage you to first raise any dispute with us directly using the contact details in Section 7, so that we can try to resolve it informally and promptly.
